What Happens After You Submit a DMCA Notice?
Once we receive a properly formatted DMCA notice, we will:
- Remove or disable access to the infringing material.
- Notify the user responsible for the content about the DMCA claim and provide them with an opportunity to respond.
Filing a Counter-Notice
If you believe that material you posted on iBerkshires.org was removed or disabled as a result of a mistake or misidentification, you may file a counter-notice. Your counter-notice must include the following information:
- Identification of the material that was removed and where it appeared before it was removed.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification.
- Your name, address, telephone number, and email address.
- You consent to the jurisdiction of the federal district court for the judicial district where your address is located. Conversely, if you are outside of the United States, you consent to the jurisdiction of any judicial district where we may be found. Additionally, this agreement ensures that any legal matters will be handled in the appropriate jurisdiction. You also agree to accept service of process from the person who provided the original DMCA notice or their agent.
